Charges filed against 15 in UMAK student hazing
09/02/2010 The Makati Prosecutor’s Office yesterday formally charged 15 persons with violation of Republic Act 8049 or Anti-Hazing Law in connection with the death of a 19-year-old University of Makati (UMAK) student, EJ Karl Intia, during initiation rites last Aug. 14. In a resolution signed and approved by City Prosecutor Feliciano Aspi, the prosecutor’s office said it finds the evidence submitted by the Makati Police sufficient to establish probable cause to charge John Reynald Marin, Roesel Wesceslao, Michael Pagulayan and Rico Mansalapus, who are now in police custody, in conspiracy with 11 others who remain at large. No bail was recommended. The prosecutor’s office also said it will issue subpoenas to 11 others who were named as participants in the hazing. They were identified as Haren Ray Tigno, Jorie Ann Acob, Sheldon Derrick Soriano, Raycon Vargas, Ronnel Galas, Mar Anthony Laroza, John Paul Buban, Jeven Soquita, Kim de Roxas, Niko Moreto and Noel Mallari. Prelimnary investigation has been scheduled for Sept. 7 and 14. Section 4 (a) of the Anti-Hazing Law imposes a penalty of reclusion perpetua in case of death as a result of the hazing. The law also specifies that officers and members of the fraternity “who actually participated in the infliction of physical harm shall be liable as principals.” On the other hand, the fifth suspect in custody, who is a minor, has been referred to the Makati Social Welfare Department. According to Prosecutor Lody Tancioco, the personal notebook of Intia and the leaflets submitted by his father, Oscar, establishes that the 19-year-old student at that time of his death had applied and was undergoing initiation to be a member of the Alpha Phi Omega fraternity. Intia’s body was retrieved from a 30-meter deep ravine along Km 99, Marcos Highway, Barangay Laurel, Sta. Maria, Laguna province last Aug. 15. He was identified by his father at a funeral home in Laguna on Aug. 20. The initiation rites occurred on Aug. 14 at 8406 Mayapis St., Barangay San Antonio, Makati. Police said Intia sustained major bruises on his legs commonly seen in fraternity neophytes who had undergone paddling during initiation rites. The autopsy revealed that the victim died from traumatic injuries to the head and lower extremities.
